Nominate a Teacher Contest Rules

By using this website or application, you are agreeing to comply with the following Terms of Use, which form a legally binding contract between you and Maui Jim, Inc., Maui Jim USA, Inc., and affiliated companies (collectively, the “Company”). Please review these Terms of Use closely!

NO PURCHASE OR PAYMENT NECESSARY FOR NOMINATIONS OR SELECTIONS. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF BEING SELECTED AS A HERO.

Eligibility: The Maui Jim Nominate a Hero Program (the “Campaign”) is open globally to participants who are 18 years old or older. Employees of Maui Jim, its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the “Employees”), and immediate family members and/or those living in the same household of Employees are not eligible to participate in the Campaign. The Campaign is subject to all applicable global, U.S. federal, state, and local laws and regulations. Void where prohibited.
Agreement to Rules: By participating, the entrant (“You”) agree to be fully unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of Maui Jim as final and binding as it relates to the content of this Campaign.
Campaign Period: Entries will be accepted online starting on Monday, April 26, 2021 at 12:00:00 am CT and ending Sunday, May 9, 2021 at 11:59:59 pm CT. Maui Jim is the official time-keeping device for the Campaign.
How to Enter: The Campaign must be entered by submitting a nomination of a person who has committed an impactful act of kindness or served in a capacity that puts others’ health, safety, and/or needs above their own. Individuals who submit nominations and nominees are not required to be a customer or follower of Maui Jim or any Maui Jim social media accounts. The entry must fulfill all Campaign requirements, as specified, to be eligible to receive Maui Jim sunglasses. Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Maui Jim. Participants may nominate more than one person, however participants must provide the information requested. Participants cannot nominate themselves. If You use fraudulent methods or otherwise attempt to circumvent the rules, your submission may be removed from eligibility at the sole discretion of Maui Jim.
Prizes: Thirty-one (31) chosen “Heroes” will receive a pair of Maui Jim sunglasses of their choice. One hero will be selected by the Maui Jim team per day in the month of May. No cash or other prize substitution shall be permitted. The prize is non-transferable. Any and all prize-related expenses including, without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of selected “Heroes” and individuals who nominate selected. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by Winner is permitted. Acceptance of prize constitutes permission for Maui Jim to use Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law. One prize per participant. Approximate retail value of each prize: Three hundred dollars ($300).

POTENTIAL WINNER IS SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE PROMOTION. A PARTICIPANT IS NOT A WINNER OF ANY PRIZE, EVEN IF THE PROMOTION SHOULD SO INDICATE, UNLESS AND UNTIL PARTICIPANT’S ELIGIBILITY (WHICH MEANS FULL COMPLIANCE WITH THE TERMS AND CONDITIONS OF THESE OFFICIAL RULES) HAS BEEN VERIFIED AND PARTICIPANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE.
Odds: The odds of winning depend on the number of eligible entries received.
Hero Selection and Notification: Heroes will be selected by Maui Jim staff from among all eligible entries received. Winners will be notified by email or phone within five (5) business days of daily hero selection (“Hero Notification”). Maui Jim shall have no liability for Winner’s failure to receive notices due to spam or other security settings or for Winner’s provision of incorrect or otherwise non-functioning contact information. If Winner cannot be contacted, is ineligible, fails to claim the prize within 3 days from the time Winner Notification was sent, or fails to timely return a completed and executed declaration and release as required, except where prohibited, the prize may be forfeited and an alternate Winner selected. Maui Jim will select up to three (3) alternate Heroes. Receipt by Winner of the prize offered in this Campaign is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER (AT Maui Jim‘S SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE CAMPAIGN, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

Maui Jim, together with its respective affiliates and related companies, including without limitation its parent, sister and subsidiary companies, retailers, franchisees, advertising and promotion agencies, suppliers of material and services related to the Campaign, and any other corporation, partnership, sole proprietorship or other legal entity directly involved in the Campaign and their respective officers, directors, employees, agents, and other representatives (the “Promotion Parties”) are not responsible for any changes or unavailability of the Web, Facebook, Instagram, or Twitter service that may interfere with the Campaign (including any limitations, any restrictions, or any conditions on Maui Jim’s ability to use mauijim.com, Facebook, Instagram, or Twitter for the Campaign as set forth herein that are not acceptable to Maui Jim) or ability of entrant to timely enter, receive notices or communicate with Maui Jim via mauijim.com, Facebook, Instagram, or Twitter, in which case Maui Jim, in its sole discretion, may terminate or modify the Campaign.

In the event of a dispute concerning who submitted an Entry, the Entry will be declared to have been made by the registered account holder of the e-mail address associated with the Instagram or Twitter account for the potentially winning entrant, but only if that person meets all other eligibility criteria.

A registered account holder is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

Potential winner(s) may be required to provide Maui Jim with proof that he/she is the registered account holder for the e-mail address associated with the Instagram or Twitter account for the potentially winning Entry. If a dispute cannot be resolved to Maui Jim’s satisfaction, the Entry will be deemed ineligible.

It is a potential winner’s responsibility to set his/her account settings to accept contacts by Sponsor and to timely check his/her email for any messages or @Replies from Maui Jim.

Multiple entrants are not permitted to share the same email. Any attempt by any entrant to obtain more than the stated number of Entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that entrant’s Entries and that entrant may be disqualified within Sponsor’s sole discretion. Use of any automated system to participate is prohibited and will result in disqualification.
Rights Granted by You: By entering this Campaign, You understand and agree that Maui Jim, anyone acting on behalf of Maui Jim, and Maui Jim’s licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Campaign, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent.
Terms & Conditions: Maui Jim reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Campaign should non-authorized human intervention, fraud, or other cause beyond Maui Jim’s control corrupt or affect the administration, security, fairness, or proper conduct of the Campaign. In such case, Maui Jim may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Maui Jim. Maui Jim reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Campaign or website or violates these Terms & Conditions. Maui Jim has the right, in its sole discretion, to maintain the integrity of the Campaign, to void votes for any reason, including, but not limited to: the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage or undermine the legitimate operation of the Campaign may be a violation of criminal and civil laws. Should such attempt be made, Maui Jim reserves the right to seek damages to the fullest extent permitted by law.
Limitation of Liability: By entering, You agree to release and hold harmless Maui Jim and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the Campaign and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error in the administration of the Promotion or the processing of entries.
Disputes: THIS Campaign IS GOVERNED BY THE LAWS OF the United States of America AND Illinois, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES, REGARDLESS OF INTERNATIONAL JURISDICTION. As a condition of participating in this Campaign, except where prohibited by law, participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Campaign, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Illinois having jurisdiction. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Campaign). Participant further waives all rights to have damages multiplied or increased.
Language: Nominations must be made in English to be considered.
Entry Pool: There will be one global entry pool considered for all submissions on a daily basis throughout the month of May. Under no circumstances will there be a separate pool of national entrants per country.

Participant’s Personal Information: Information collected from participants is subject to Maui Jim’s Privacy Policy, which is available at: https://www.mauijim.com/US/en_US/privacy. By participating in this Campaign, participants hereby agree to collection and usage of their personal information in accordance with Maui Jim’s privacy policy and acknowledge that they have read and accepted Maui Jim’s privacy policy.
